Voicemaxx Terms of Service

Welcome to Voicemaxx. These Terms of Service ("Terms") govern your access to and use of the Voicemaxx iOS and Android applications, websites, account services, and related features (collectively, the "Services"), operated by Starquest Studio LLC ("we," "us," or "our"), a Massachusetts limited liability company.

By downloading, installing, purchasing, or using Voicemaxx, you agree to be bound by these Terms, our Subscription Terms, when applicable, and our Privacy Policy. If you do not agree, do not use the Services.

1. Description of Service

Voicemaxx is a voice-training app with a guided daily-drill course, voice recording and analysis, an optional adult community voice-rating feature ("Voice Arena"), an optional adult AI-analyzed selfie feature ("LooksMaxx"), and an adult friend-referral program. Access to the full adult course and certain adult features requires a paid subscription.

2. Eligibility

You must be at least 9 years old to use the Android app. Users under 18 receive a restricted private experience and may not use accounts, community sharing, dating practice, selfie analysis, referrals, or purchasing. If you purchase a subscription or use an adult-only feature, you represent that you are at least 18 and legally able to enter into a binding contract.

3. Accounts & Your Data

Adult users create an account to access account-gated results and paid features. Voice recordings, onboarding answers, signature, and course progress are primarily stored locally on your device, as described in our Privacy Policy. Voice Arena data is uploaded only when an adult expressly chooses to share it. You may delete your account in Profile or at our account-deletion page.

4. Subscriptions, Merchandise & Payments

4.1 Subscription Plans

Voicemaxx offers auto-renewing subscription plans through the website, Apple App Store, and Google Play, and may offer different durations, free trials, or reduced first periods. The purchase screen identifies the billing provider and shows the price, period, renewal terms, and offer eligibility before payment. Our Subscription Terms contain the detailed billing, cancellation, refund, and territorial consumer-right terms.

4.2 Billing

App subscriptions may be processed through Apple In-App Purchases or Google Play Billing. Website subscriptions are processed by Stripe. We do not receive or store your complete payment-card number. The applicable billing provider's terms and policies also apply to its payment service.

4.3 Auto-Renewal

Subscriptions renew automatically at the price and frequency disclosed before purchase until canceled. You can cancel online at Manage subscription: website plans use our secure email-code flow, Apple-billed plans use Apple Subscriptions, and Google-billed plans use Google Play Subscriptions. Normal cancellation is free, stops future charges, and ordinarily preserves access through the paid period. Deleting the App or account does not cancel billing.

4.4 Introductory Offers & Free Trials

A plan may include an introductory price or free trial disclosed at checkout. Unless canceled in time, it converts to the regular paid auto-renewing plan shown before purchase. The applicable billing provider determines and enforces offer eligibility.

4.5 Price Changes

We may change subscription pricing going forward. Any change takes effect only after the notice, consent, or other process required by the billing provider and applicable law.

4.6 Refunds

Apple and Google handle refunds for purchases they bill. We handle website-subscription refund and statutory withdrawal requests. Except where the applicable store rules or law require otherwise, a charge for a billing period that has begun is not refundable merely because you stop using Voicemaxx. This does not limit any non-waivable cooling-off, withdrawal, consumer-guarantee, unauthorized-charge, service-failure, or other statutory remedy described in the Subscription Terms.

4.7 Physical Merchandise

Voicemaxx may offer optional physical products, including the Voicemaxx Gold Training Straw. Merchandise purchases are separate from your App subscription and are processed as one-time payments through Stripe Checkout. The item price, quantity, available shipping destinations, shipping charge (if any), and total are shown before you confirm payment. Stripe's checkout and consumer terms apply to its payment service.

You are responsible for providing an accurate delivery address and contact information. Product availability and delivery estimates are not guaranteed until your order is accepted. For merchandise order support, including a cancellation, return, damaged item, or refund request, contact [email protected]. Any product-specific return or refund terms disclosed at checkout also apply.

5. Intellectual Property

All content, materials, courses, drills, audio, designs, and software within the App are the exclusive property of Starquest Studio LLC or its licensors and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. You may not:

• Copy, modify, distribute, or create derivative works based on the App or its content
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App's content for commercial purposes without our written permission
• Remove or alter any proprietary notices, trademarks, or branding
• Resell, sublicense, or transfer your access to the App

Recordings and images you create in the App (your voice takes, your selfies, your signature) remain yours. By using the LooksMaxx and AI-conversation features, you grant us a limited license to transmit that content to the third-party processors described in our Privacy Policy solely to provide the feature you requested.

6. Voice Analysis & AI-Powered Features

• Voice pitch, resonance, and clarity scoring, and the deepened-voice preview, run entirely on your device.
• The optional LooksMaxx feature and the optional AI practice-conversation feature send data (a selfie, or transcribed speech text, respectively) to third-party AI providers for real-time processing, as described in our Privacy Policy.
• AI-generated scores, tips, and roleplay responses are provided for entertainment and self-improvement purposes only and do not constitute professional, medical, or cosmetic advice of any kind.
• Results (voice scores, LooksMaxx ratings) are estimates generated by automated analysis and may not be accurate or consistent between sessions.

7. Voice Arena (Community Voice Sharing)

Voice Arena is an optional community feature. Your voice test is private by default and analyzed on your device. If — and only if — you choose to share a recording to Voice Arena, the following applies:

• Public sharing. Your recording, together with the display name and accent description you enter, is uploaded to our servers and made available to other Voicemaxx users, who may listen to it, rate it on a set of vocal qualities, and leave short descriptive feedback. Do not share a recording, name, or accent description you are not comfortable making public.
• Your content and license. You retain ownership of your recording. By sharing it to Voice Arena, you grant us and other users a worldwide, non-exclusive, royalty-free license to host, store, stream, and display that recording, your chosen display name, and your accent description within the App to operate the feature. You represent that the recording is of your own voice and that you have the right to share it.
• Rating others. When you rate another user's recording, you agree to do so honestly and respectfully. Ratings and any comments you submit are shown to the recording's owner and are attributed anonymously.
• No objectionable content. You must not upload, share, or transmit any recording, name, accent description, or comment that is unlawful, harassing, hateful, threatening, defamatory, sexually explicit, or otherwise objectionable, or that impersonates another person or infringes anyone's rights. This is a condition of using Voice Arena.
• Zero tolerance; reporting, blocking, and removal. We operate a zero-tolerance policy toward objectionable content and abusive users. Any user can report a recording; a reported recording is removed from circulation immediately, pending review. You can also block another user so their recordings never appear to you again. We may remove any content and suspend or permanently bar any user from Voice Arena or the App at our sole discretion, including for a single violation. If your recording is removed after a report and you believe this was a mistake, you may contest it in the App and we will review it manually.
• Retirement. A shared recording is shown to a limited number of raters and then retires, with your results kept. You can remove a shared recording at any time by recording a new one, and you can decline to participate at any time.

Voice Arena is for adults only. By using it you agree to our Community Guidelines and consent to the public sharing and collection described in our Privacy Policy.

8. Squad Referral Program

Voicemaxx may offer an optional referral program in which you can invite friends within a limited time window in exchange for a reward. Participation is voluntary, requires you to provide an email address for reward delivery, and is subject to the specific terms, windows, and eligibility rules presented in the App at the time. We may modify, suspend, or discontinue this program at any time.

9. Health & Wellness Disclaimer

Voicemaxx is not a medical device, speech-therapy service, or substitute for professional medical or vocal care.

The App provides general voice-training exercises, educational content, and entertainment-grade aesthetic feedback. It does not provide medical diagnosis, clinical treatment, or professional counseling. You acknowledge that:

• The App is designed for general self-improvement and educational purposes only.
• No content within the App should be interpreted as medical, dermatological, or therapeutic advice.
• AI-generated feedback is not a substitute for professional consultation.
• You should consult a licensed physician, otolaryngologist, or speech-language pathologist for any medical concern about your voice.

10. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Upload photos of anyone other than yourself, or of anyone without their consent, to the LooksMaxx feature
• Attempt to gain unauthorized access to the App's systems or infrastructure
• Interfere with or disrupt the operation of the App
• Use automated means (bots, scrapers, etc.) to access the App or its content
• Abuse the squad referral program (e.g. self-referral, fake accounts, or fraudulent redemptions)
• Upload, share, or transmit through Voice Arena any recording, name, accent description, or comment that is objectionable, unlawful, harassing, hateful, sexually explicit, defamatory, or infringing, or any recording that is not of your own voice
• Harass, abuse, impersonate, or harm another user through Voice Arena ratings, comments, or the reporting system, or misuse reporting to target non-violating content

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that AI-generated scores or feedback will be accurate.
• We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall Starquest Studio LLC, its officers, directors, members, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or loss of profits, arising out of or in connection with your use of the App.

Our total aggregate liability for any claim arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty U.S. dollars ($50), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Starquest Studio LLC and its officers, directors, members, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your violation of these Terms or any applicable law, or any claim that your use of the App caused damage to a third party.

13. Termination

We may suspend or terminate access for violations of these Terms, subject to mandatory consumer rights. You may stop using the Services, delete your account, and delete the App at any time. Deleting an account or App does not cancel a subscription; use Manage subscription. An ordinarily canceled subscription continues until the end of its paid period unless a valid withdrawal, refund, or immediate-termination right applies.

14. Modifications to These Terms

We may update these Terms from time to time. The "Last Updated" date above will be revised, and material changes may be communicated within the App or through the applicable app store. Continued use after changes take effect constitutes acceptance of the revised Terms.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days.

15.2 Arbitration

To the extent permitted by the mandatory law that applies to you, if the dispute cannot be resolved informally, you and Starquest Studio LLC agree that a dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. Arbitration shall take place in Berkshire County, Massachusetts, or remotely at the election of either party. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. This section does not apply where consumer law makes pre-dispute arbitration invalid or preserves your right to bring a claim before a court or consumer authority.

15.3 Class Action Waiver

To the extent permitted by applicable law, dispute resolution proceedings will be conducted only on an individual basis, not as a class, consolidated, or representative action. This waiver does not apply where it would limit a non-waivable consumer right or remedy.

15.4 Exceptions

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-law provisions. This choice does not deprive a consumer of mandatory protections or access to courts and authorities that cannot lawfully be waived in the consumer's place of residence.

17. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Subscription Terms and Privacy Policy, constitute the agreement between you and Starquest Studio LLC regarding your use of the Services and supersede prior agreements or understandings on the same subject.
